Refund *

Within 24 hours Buyer may notify Seller they wish to return the puppy. We will arrange for transport back at buyers cost, have the puppy examined by our veterinarian, and quarantined for 9 days. If after that period the puppy is in the same healthy condition as when it left with Buyer in it will be placed for sale at fair market value (which may be less than you paid due to uncontrollable market fluctuations; Once re-sold Seller will refund Buyer the re-sale price minus any shipping fee(s), vet examination, and original deposit;

Health Warranty *

Seller certifies that this puppy is to the best of their knowledge healthy at time of sale. Every precaution has been taken including but not limited to multiple vaccinations, and de-worming as recommended by a licensed veterinarian and recorded in the health record that will accompany the puppy. While every effort is made to ensure our dogs are bred from only healthy bloodlines, Seller gives no warranty as to conformation, adult size, temperament, or breeding capability of any puppy; Furthermore, Seller does not warranty against conditions brought on by stress or environmental changes that we cannot control once the puppy leaves our care; therefore this health guarentee does not cover hypoglycemia, parasites, giardia, viral or bacterial infections, as well as parvo, coccidiosis, distemper, mycoplasma, brucellosis, or coronavirus because these are highly contagious diseases that can be contracted immediately upon leaving and/or in transit to their new homes;

The following is required to validate the health warranty *

Buyer is required to have the puppy examined by a state licensed veterinarian within 48 business hours of purchase at Buyers expense
Puppy must continue to receive 5 way vaccinations until 16 weeks old (no more than 3 weeks apart) as well as annual boosters
Puppy must have (age appropriate) current rabies vaccinations
Puppy must be spayed/neutered by the age of 1 year unless full AKC rights are purchased
Puppy must be fed Life's Abundance kibble *
Puppy must receive either Life's Abundance or Nu-Vet Vitamins
If the above validations are met and the puppy/dog purchased thru this contract is diagnosed by a licensed veterinarian to have a verifiable genetic** or life-threatening*** health defect, he/she may be returned to Seller for a replacement of equal value at Sellers discretion;
If Buyer decides to keep the puppy/dog instead of return it to the seller they will be credited half off of the listed price of a new puppy; All medical and/or rehabilitation bills incurred for the puppy/dog are the responsibility of the Buyer and will not be refunded by the seller; Buyer is responsible for all shipping, health certificates, carriers, vet examinations, and quarantine fees of the original and replacement puppy.

* We are aware there are other vet recommended dog foods that may be equal quality to Life's Abundance however LA feeds have NEVER had a recall, are not stored on store shelves for unknown periods of time depleting the nutritional value, and is traceable for verification of requirements.

** **Genetic (inherited) Defects include: Over/underbite, hip, eye, hernia, or spinal defects, cryptorchidism (puppy must be minimum one year before it can be returned for this condition as I have witnessed an occasional pup taking this long to drop both testies), not including any of the above caused by accidents, illnesses, health conditions caused by improper care, and expressly excluding any items listed as special terms.

*** Life-threatening defects do not include accidents, cancer, seizures (unless proven to be genetically caused), health conditions caused by improper care, or communicable diseases such as Parvo, Rabies, Brucellosis, Mycoplasma, Hypoglycemia, or Coccidia expressly excluding any items listed as special terms.

The following is required to validate the health warranty (copy) *

Buyer is required to have the puppy examined by a state licensed veterinarian within 48 business hours of purchase at Buyers expense
Puppy must continue to receive 5 way vaccinations until 16 weeks old (no more than 3 weeks apart) as well as annual boosters
Puppy must have (age appropriate) current rabies vaccinations
Puppy must be fed Life's Abundance kibble *
Puppy must receive either Life's Abundance or Nu-Vet Vitamins
If the above validations are met and the puppy/dog purchased thru this contract is diagnosed by TWO separate licensed veterinarians (different offices) to have a verifiable genetic** or life-threatening*** health defect, he/she may be returned to Seller for a replacement of equal value at Sellers discretion;
If Buyer decides to keep the puppy/dog instead fo return it to the seller they will be credited half off of the listed price of a new puppy; All medical and/or rehabilitation bills incurred for the puppy/dog are the responsibility of the Buyer and will not be refunded by the seller; Buyer is responsible for all shipping, health certificates, carriers, vet examinations, and quarantine fees of the original and replacement puppy.

Additional Provisions and Terms of Sale *

Buyer understands that all transportation of the puppy/dog from and if necessary returning to Sellers home is solely the responsibility of the buyer;
If at anytime in it's life the puppy/dog needs to be placed in a new home Buyer agrees to notify Seller. We will be happy to list the puppy/dog on our site to aid in finding a suitable new home. Under no circumstances will should puppy be re-sold thru a puppy broker, or pet store. To do so may result in persecution by Seller for breach of contract;
If you are at anytime unable to continue care of the puppy/dog or find it a suitable replacement home it may be returned to seller. We will arrange for transportation back, have the puppy/dog quarantined for 9 days and then examined by our veterinarian. If the puppy/dog is in good health we will offer it for adoption. All transportation, medical, and/or rehabilitation bills incurred for this puppy/dog are the responsibility of the buyer and will not be refunded by the seller.
Buyer agrees to maintain the puppy/dog in good condition, including adherence to a regular immunization/de-worming schedule, proper diet, and a clean , safe, loving environment.
Buyer agrees they, and/or their spouses, significant other, or guests if applicable, will not criticize, defame, be derogatory toward or otherwise disparage the Seller, its animals, products, services, home, kennels, or any past, present and future attorneys, agents, representatives, employees, or affiliates, including but not limited to any animal husbandry practices, plans or actions, to any third party, either orally, online, or in writing; provided, however, that this provision will not preclude Buyer from giving truthful testimony in response to a lawful subpoena.

Acceptance

Buyer hereby acknowledges having read the terms of the contract and does hereby agree to abide by each of the provisions set forth in this contract as a whole. This contract is a legal instrument and supersedes all previous agreements whether verbal or written and is governed by the laws of the state of Utah. All legal disputes to this contract must be delivered to the Seller in written form and addressed within the courts of Beaver, Utah.
